Allamakee Co. Divorce Records

Unless otherwise noted, these are Original Notices announcing that a divorce petition was filed. They were published in local newspapers. The original notices are not proof that a decree of divorce was ever granted. If a divorce was granted, the record should be at the Allamakee county Court House.


April 1868

Newbury - Original Notice. To James H. Newbury
You are hereby notified that on or before the 1st day of April 1868, a petition will be filed by Louise Newbury, in the office of the Clerk of District Court of said Allamakee County, IA claiming of you a divorce from the bonds of matrimony. And unless you appear thereto and defend before noon of the 2nd day of the next term of said court, commencing on the 15th day of June 1868, default will be entered against you and judgment rendered thereon.

You are hereby notified that on of before the 1st day of December 1868, a petition will be filed by said plaintiff, Mary E. Dergan, in the office of the Clerk of District Court of said Allamakee County, IA, claiming of you a divorce from the bonds of matrimony and alleging as a cause, that after her marriage to you, you became addicted to habitual drunkenness, and unless you appear thereto and defend before noon of the 2nd day of next term of said court, commencing on the 21st day of December 1868, default will be entered against you and judgment rendered thereon.

To Mary Jane Vansickle, deft. You are hereby notified that, on or before the 22nd day of Jan., 1879, a petition will be filed by said Plaintiff, John H.H. Evert - Original Notice - In the District Court, Allamakee County, Iowa; Flavia Eppina Evert vs Frederick Evert.
To Frederick Evert, the Above named defendant: You are hereby notified that there will be on file in the office of the Clerk of the District Court of Allamakee County, Iowa on the 30th day of March, 1900, the petition of said plaintiff claiming and demanding a degree of divorce against you from the Bonds of matrimony on the grounds of habitual drunkenness, inhuman treatment, non-support, [illegible word], and for the custody of minor child. April 1929

Kugler vs Kugler - District Court - The case of Myrl B. Kugler vs. Clark G. Kugler, a divorce action, was heard by Judge Reed Monday afternoon. The plaintiff, living at New Albin, represented by attorney Frank May of Lansing asked for a divorce from the defendant, who lives at Osage, on the grounds of cruel and inhuman treatment, desertion and nonsupport. Several witnesses for the plaintiff were examined and there was no defense. The divorce was granted.

Laughlin - Original Notice - In the District Court of Iowa, in and for Allamakee County; Elizabeth Mary Laughlin, plaintiff vs Andrew Donald Laughlin, defendant
To Andrew Donald Laughlin:  You are hereby notified that on or before the 27th day of August, A.D. 1931, a petition of  Elizabeth Mary Laughlin will be filed in the office of the Clerk of the District Court of the State of Iowa, in and for Allamakee county, praying that she be divorced from you, and alleging as a ground for divorce cruel and inhuman treatment endangering her life. And unless you appear thereto and defend on or before noon of the second day of the September term, A.D., 1931, of said Court, which will commence on the 7th day of September, A.D. 1931, at the court house in Waukon, Iowa, default will be entered against you, and decree rendered thereon.  For further particulars you are referred to the petition to be filed as above stated.

Rahilly - Original Notice - In the District Court of Iowa, in and for Allamakee County; E. Rahilly, plaintiff vs Dorothy Bitker Rahilly, defendant
To Dorothy Bitker Rahilly:  You are hereby notified that there is now on file in the Office of the Clerk of the District Court of Iowa, in and for Allamakee County, Petition of above named Plaintiff alleging that plaintiff is the husband of defendant, and they were married during the last week of August, 1932, that defendant during the latter part of their married life has been guilty of such cruel and inhuman treatment as to endanger the life of plaintiff, that defendant has at this time, without any cause, unlawfully, willfully and maliciously left the home of plaintiff, and to the best of plaintiff’s knowledge and belief, no longer resides in the State of Iowa.  Plaintiff asks that he be granted an absolute divorce from defendant. .  For further particulars you are referred to the petition as above stated. Now unless you appear thereto and defend on or before noon of the second day of the March term, A.D., 1934, of said Court, which will convene on the 19th day of  March, A.D. 1934, at the court house in Waukon, Iowa, default will be entered against you as prayed for in said petition.

August 1936

Headington. Waukon, Ia. - A divorce was granted Tuesday by Judge T.H. Goheon to Mrs. Tena Headington from her husband, Grover Headington, the charges being cruel and inhuman treatment. Plaintiff was given the farm in French Creek township and part of the personal possessions. Also custody of the minor child, a boy 14 years old. They were married Feb 22, 1910, and have three children.
